Judge Reserves Decision In Bomek Trial

The crown has withdrawn one of the charges laid against a Flin Flon man accused of sexually assaulting a boy in Prince Albert.

 

57 year-old James Michael Bomek initially faced 12 separate offenses for alleged actions he took between August 2004 and May 2005.

 

Yesterday, during closing arguments prosecutor Peter Hryhoychuk withdrew one charge of obtaining sexual services.

 

Bomek still faces 11 other charges including creating and possessing child pornography, sexual assault and inviting someone under the age of 14 to touch him.

 

Bomek’s lawyer has told court he never meant to distribute the pictures and that he didn’t know the boy was under the legal age of consent.

 

The crown contends Bomek didn’t attempt to find out the boy’s age and that possessing photos of naked teenagers is still illegal.

 

The Judge will rule on the case on January 10th.
