An Aboriginal man designated as a dangerous offender will get a chance to appeal the designation.

36 year-old Mitchell Moise had been designated as a dangerous offender after he pled guilty to the assault of a 17 year-old girl in 2007.

Because of the conviction Moise was designated as a dangerous offender and was sentenced to an indeterminate period of incarceration.

In an appeal hearing Moise argued that he did not exhibit the “pattern of behaviour” associated with a dangerous offender.

The Appeals judge says the sentencing judge erred in designating Moise as a dangerous offender after failing to follow a precedent from a previous case.

The judge has now set aside the dangerous offender designation and a new hearing has been ordered.

According to Saskatchewan Court of Appeal documents, Moise spent most of his life in between Gordon Muskowekwan First Nations.
