Matrimonial Property Rights Issue Far From Settled

The president of the Native Women’s Association of Canada says she’s waiting to hear how Indian Affairs Minister Jim Prentice views the contentious issue of matrimonial real property on reserves.
Beverly Jacobs says a report on the subject was given to Indian Affairs last month. So far, there’s been no response from the department.
Jacobs worries not enough female band members are being consulted.
She says Prentice needs to take the views of female band members into account when he drafts a new policy.
Jacobs says her group has talked to many First Nations women about the issue, and is struck by how many stories there are out there of women who get left out of divorce settlements.
She says many wind up homeless, and are forced to move in with family members or head to cities.
Jacobs adds most women her group talks to support their bands, but want the issue to be revisited on a more equitable level.
She notes most band councils across the land are dominated by men.
At the same time, Jacobs stresses there are success stories out there as some chiefs are formulating progressive strategies with their women.
She also stresses that “no one”, especially her organization, wants to see provincial laws used to solve the problem.
