Tuesday in Prince Albert provincial court, Judge Stephen Carter ruled that based upon the evidence, no reasonable jury – properly instructed – would find the 21 year-old woman guilty of the crime.

Charles was charged after an infant was rushed to hospital last fall suffering from severe trauma to the head and body.

Since that time Charles’ 23 year-old boyfriend George Daryl Bighead has pleaded guilty to assault and was sentenced to 70 months in jail.

Peter Burns is Charles’ defense attorney. He says justice has been served.

Mary-Anne Friesen was the crown prosecutor for the preliminary hearing, she says she’s disappointed with the judge’s decision.
